What is a Civil Lawsuit?
In a civil case, two or more parties are involved in a dispute. A civil lawsuit begins with the filing of a complaint and the payment of the filing fee stipulated by law. The plaintiff may file for in forma pauperis status if he or she is unable to pay the filing fee. Upon approval, the fee will be waived.
What Are the 6 Steps in a Civil Case?
Although every civil lawsuit is different, most civil lawsuits follow essentially the same process. A person who files a civil lawsuit against another party is called the plaintiff. The defendant is the one being accused. Unlike a criminal case, which is for seeking punishment, a civil action for recovering damages from a wrongdoing that caused harm or did not fulfill a contract.
How to File a Civil Lawsuit
The following process explains the steps of a civil lawsuit:
Step 1: Pre-filing
A dispute arises between two or more parties where at least one party makes particular demands of the other. Failed attempts to negotiate a resolution will progress things towards settling the matter in court.
Step 2: Initial Pleading
One party files a complaint against the other party to initiate the court proceeding. The other party files a response to the complaint.
Step 3: Discovery
Each party exchanges information with the other to learn about specific details that are related to the dispute.
Step 4: Pre-Trial
Preparations are made for trial, including the gathering of evidence and witnesses. Attempts at settlement can be made during this stage, and the parties have an opportunity to file a motion to the court to resolve the case or to set parameters on the issues addressed in the trial.
Step 5: Trial
Each party is given the opportunity to present his or her side of the story before a judge or jury, supported by the presentation of evidence and witness statements. Witnesses can also be cross-examined during this time. The case will be decided, and a judgment will be entered.
Step 6: Post-Trial
Each party is subject to any obligations that were placed upon them in the judgment. The individual who lost also has the opportunity to appeal the decision.
Not all cases follow this procedure. Instead, they have their own processes as laid out by the court. If your litigation matter has a unique situation and requires a different procedure, our civil litigation lawyers in Las Vegas can let you know what needs to be done to get you the most desirable result possible.
